Elton mayor files suit halting recall petition

A state district judge will consider a temporary restraining order Friday attempting to block a recall election against Elton Mayor Kesia Lemoine.
A lawsuit seeking the temporary restraining order and preliminary injunction was filed Monday by Lake Charles attorney Katie T. Dominic on behalf of Lemoine in the 31st Judicial District Court in Jennings. Lemoine is also seeking damages due to the recall efforts.
The lawsuit names Gov. John Bel Edwards, Secretary of State Kyle Ardoin and Jeff Davis Parish Registrar of Voters Joann Blair as defendants. Petition organizers Jared Trahan and Marilyn Granger were also listed as defendants.
Trahan and Granger began the recall petition in August. It was validated by the Registrar of Voters in November with 249 certified signatures and forwarded to Gov. Edwards.
In the eight-page lawsuit, Lemoine claims the petition contained several discrepancies including residents who no longer live in Elton or have changed addresses, those who are registered to vote in another parish and at least one whose address is a vacant lot. It also contends that Granger failed to observe the electors signing the petition.
It further alleges that Blair, as the registrar of voters, failed to conduct a thorough investigation into the signatures and addresses provided on the recall petition, raising concerns about her competence and commitment to the recall procedures.
The recall petition is the second attempt to remove Lemoine from her post.
In May, former mayoral candidates Brandon Kelly and Brandilyn Soileau filed a recall petition against Lemoine. The petition was rejected because it lacked a sufficient number of valid signatures. Of the 322 signatures, only one was deemed certified as a valid voter.
Lemoine contends that removing her from office will result in damages to her reputation, personal stress, emotional toll, career limitations and have an impact on her family.
