A Jeff Davis Parish sheriff’s deputy was injured Friday when his taser was taken by a suspect and used against him, resulting in the deputy discharging his service weapon, a state police investigation has found.

The suspect, identified as Mark Gabriel Buller, 44, of Iowa, La. was arrested on charges of attempted first-degree murder, attempted disarming of a police officer, disarming a police officer, aggravated second-degree battery, resisting a police officer with force or violence and attempted theft of a motor vehicle. Buller has an active warrant for failure to register as a sex offender and simple burglary.

Buller was booked into the Jeff Davis Parish Correctional Center where he was being held without bond on Monday.

“The preliminary investigation revealed that a Jeff Davis Parish Sheriff’s Office deputy stopped to assist Buller, who was walking on La. 99 in inclement weather and a poorly lit area,” Troop D Public Affairs Trooper Matthew Gaspard said in a press release.

During the encounter, a physical altercation occurred in which Buller was able to gain possession of the deputy’s taser and use it against him before attempting to take the deputy’s patrol car, Gaspard said. The deputy then discharged his service weapon, but did not strike Buller, he said.

Responding deputies and officers arrived at the scene and were able to take Buller into custody without further incident, Gaspard said. Both the deputy and Buller were brought to area hospitals for non-life-threatening injuries which were received during the altercation.

Jeff Davis Parish Sheriff Kyle Miers identified the deputy on Sunday as Patrol Sgt. Josh Clement. He said Clement had stopped to help Buller who was walking on a dark high in the cold.

Miers requested assistance from the state police to investigate the weapon discharge.

The investigation remains active and ongoing, Gaspard said.
