A Lake Charles man was arrested Saturday morning after a girl under the age of 13 gave birth to his child.

Calcasieu Parish Sheriff’s office spokeswoman Kayla Vincent said their office was called at 3 am Saturday morning by a local hospital in reference to a girl, under the age of 13, who had given birth.

During the initial investigation, detectives spoke with the victim who stated Jose L. Montoya, 39, had sexual intercourse with her numerous times over the past two years, Vincent said.

“When detectives spoke with Montoya he confirmed the allegations,” Vincent said. “He also advised detectives the newborn is likely his child.”

Montoya was arrested and booked into the Calcasieu Correctional Center and charged with two counts of first-degree rape.

His bond has been set at $750,000.
