The 3rd Circuit Court of Appeal has denied a re-hearing in the case of a man who was found guilty of second-degree murder on Dec. 17, 1999, in state district court.
Michael W. Withers was sentenced to life in prison after being convicted in the death of Jennifer Andrew.
Withers has appealed his conviction and sentence multiple times through the years, alleging things such as ineffective counsel as well as claims that counsel should have hired a psychologist to examine him.
He also alleged that counsel did not raise an intoxication defense on his behalf.
The Louisiana Supreme Court as well as 3rd Circuit Court of Appeal have denied his appeals over the years.
In another response, the state district court said his appeals were “repetitive.”
The state Supreme Court noted in 2018 in a denial of another appeal that Withers had fully litigated his application for post-conviction relief in state court.
After being convicted, Withers was sentenced to life without the benefit of probation, parole, or suspension of sentence.
He is serving out his sentence at Louisiana State Penitentiary at Angola.
